Terms of Service

Welcome to Vibe. These Terms & Conditions ("Terms") govern your access to and use of the Vibe mobile application, website, and related services (collectively, the "Service"), provided by Vibe ("we", "us", "our").

By downloading, registering, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Definitions

  • Service: Vibe mobile app, website, APIs, and related features.
  • App Store Providers: Apple App Store, Google Play Store, or similar distribution platforms.
  • User Content: Content you post, upload, or submit (photos, text, tags, ratings, comments, locations, etc.).
  • MVP / Beta: Early-stage version of the Service with evolving features and potential limitations.

2. Eligibility & Account Registration

You must be at least 16 years old (or the minimum legal age in your jurisdiction) to use Vibe. You are responsible for maintaining the confidentiality of your account credentials and for all activity on your account. Notify us immediately of any unauthorized use or security breach.

3. Acceptance & MVP Notice

You acknowledge that Vibe is currently an MVP/Beta product. Features, performance, and design may change, be suspended, or removed without notice. The Service is provided "as is" for testing, feedback, and personal use. We do not guarantee uninterrupted access or feature continuity.

4. The Service — What Vibe Does (and Does Not)

Vibe helps users see and share the real-time energy ("vibe") of places—cafés, bars, streets, and venues—based on user submissions and public signals. We do not guarantee accuracy, completeness, or real-time performance of any displayed information. Always exercise personal judgment and follow local laws and venue policies.

5. User Content & License

You are solely responsible for any content you share. By submitting content, you grant Vibe a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, display, reproduce, distribute, and modify your content for the purpose of operating, improving, and promoting the Service. You retain ownership of your content. We may remove content that violates these Terms or applicable law.

6. Prohibited Content & Conduct

You agree not to:

  • Post or share unlawful, defamatory, obscene, or discriminatory material;
  • Promote hate, harassment, or violence;
  • Post spam, solicitations, or unauthorized advertising;
  • Infringe upon others' privacy, IP, or personal data;
  • Impersonate others;
  • Attempt to disrupt, reverse-engineer, or exploit the Service.

We may suspend or terminate users for violations.

7. Moderation & Reporting

We may label, restrict, or remove content automatically or manually. If you believe your rights are violated or content should be removed, email: contact@seethevibe.com. For copyright claims, see Section 17 (DMCA & Copyright).

8. Subscriptions & In-App Purchases

Vibe may offer:

  • Free tier: "Vibe Seeker"
  • Premium tier: "Vibe Explorer" (subscription)
  • In-app purchases: Access to exclusive content, experiences, or filters

Pricing and payment terms are displayed within the app and managed by App Store Providers.

9. Third-Party Integrations

Vibe may integrate external data or APIs (e.g., maps, social media, events, payments). We are not responsible for third-party actions, data accuracy, or outages. By connecting an external service, you authorize Vibe to access relevant data as allowed under that platform's API and terms.

10. Safety & Accuracy Disclaimer

Vibe's real-time signals are community-driven estimates and may be inaccurate or delayed. Use the Service responsibly. Vibe is not responsible for injury, loss, or damages from reliance on displayed content. Always use personal judgment when visiting public locations.

11. Privacy & Data Protection

Your data is handled in accordance with the Vibe Privacy Policy. By using the app, you consent to the collection and use of your data as outlined therein. EU users have GDPR rights (access, rectification, erasure, portability, objection). Requests: contact@seethevibe.com

12. Intellectual Property

All trademarks, design, branding, code, and non-user content are owned by Vibe or its licensors. You may not reproduce, distribute, or modify any part of the Service without written consent. Feedback or ideas submitted to Vibe may be freely used to improve the product.

13. Warranties & Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, express or implied, including merchantability, fitness for purpose, or non-infringement. We do not warrant uninterrupted access, accuracy, or error-free operation.

14. Limitation of Liability

To the fullest extent permitted by law, Vibe and its affiliates shall not be liable for indirect, incidental, or consequential damages, including loss of data, revenue, or goodwill. Total liability, if any, shall not exceed €100 or the amount paid in the preceding 12 months.

15. Indemnification

You agree to defend, indemnify, and hold harmless Vibe and its affiliates from claims arising from your content, breach of Terms, or unlawful use of the Service.

16. Account Suspension & Termination

We may suspend or terminate accounts for violations or compliance reasons. Upon termination, your license to use the Service ends. We may retain or delete your data consistent with our policies and legal obligations.

17. DMCA & Copyright

Send infringement notices to contact@seethevibe.com including:

  • Authorized signature,
  • Identification of copyrighted work,
  • Infringing content and its location,
  • Contact information,
  • Good-faith statement and accuracy declaration.

Valid notices will be reviewed, and infringing material may be removed.

18. Dispute Resolution & Governing Law

These Terms are governed by German law. Disputes shall be resolved exclusively in the courts of Berlin, Germany, unless local consumer protection laws require otherwise.

19. Changes to Terms

We may update these Terms periodically. Material updates will be communicated in-app or via email. Continued use signifies acceptance of the revised Terms.

20. Force Majeure

We are not responsible for delays or failures caused by events beyond our control (natural disasters, strikes, cyberattacks, or legal restrictions).

22. Acknowledgement
